Fairfax Collaborative Divorce Attorney
In a Collaborative Divorce, spouses work to negotiate a Marital Settlement Agreement that addresses the goals, interests, and needs of both spouses as well as the best interests of their children while maintaining an atmosphere of respectfulness and cooperation. Each spouse enjoys the support and guidance of his or her own attorney; however, both lawyers are trained in the Collaborative Process and they formally agree to stay out of the court system and help you reach a settlement.

Uncontested Divorce Services
An uncontested divorce, sometimes called a "kitchen table" divorce, exists when the parties are able to resolve all issues stemming from the dissolution of their marriage on their own. In such cases, Kales & Kales, PLC will draft a Marital Settlement Agreement, which memorializes that agreement, for our client and prepare and process all court papers required for his or her divorce. We charge an affordable fee for our services, which is based upon the case's complexity.

Divorce Litigation
In litigation, parties rely upon the court system and judges to resolve their issues. Unfortunately, in litigation, spouses often come to view each other as adversaries and may incur substantial financial and emotional costs; however, sometimes going to court is the only option that will work. If you are considering a traditionally litigated case, please contact us to discuss.

Common Questions About
Divorce Mediation & Collaborative Divorce

Can I still have a lawyer if I choose divorce mediation?

Yes. Mediation does not prevent you from having an attorney. We recommend each spouse have their own lawyer review the final agreement and provide legal advice between sessions. Your attorneys don’t usually attend mediation sessions, but you can consult them throughout the process.

A mediator is a neutral third party who helps both spouses reach one agreement. A collaborative attorney represents only one spouse in private negotiations. Both attorneys at Kales & Kales mediate cases. Jonathan also maintains a collaborative divorce practice for clients who want a dedicated attorney representing their interests.
Contact us for pricing — mediation is billed hourly per session, with no retainer required to begin. A deposit is requested when drafting the written agreement, and final costs depend on the complexity and number of sessions in your case.
No. You can start with open issues. The mediation process helps you work through them together.

No. We do not handle court litigation for divorce. We focus on out-of-court processes like mediation and collaborative divorce. If you and your spouse cannot agree to negotiate, we can refer you to a litigation attorney.

We typically respond to all inquiries by the next business day. Call (703) 896-7580 or email us to get started.
